Terms of Service

By accessing or using PhotoSelect, you agree to these Terms of Service. If you do not agree, do not use the service.

PhotoSelect provides workflows for event photographers and their clients/guests, including album management, guest access, selection collection, protected delivery, and related analytics and communication features.

PhotoSelect is a software platform provider. Photographers are responsible for the lawfulness of event media, guest outreach, and consent collection in their own events.

You must provide accurate information and keep credentials and session access secure. You are responsible for activities under your account and for complying with applicable law.

You may not use PhotoSelect for unlawful activity, abuse, unauthorized access, malware distribution, infringement, or attempts to disrupt platform integrity, security, or availability.

You retain rights to your content. You represent that you have all required rights, permissions, and consents for uploaded media and guest communications, including consent obligations under applicable privacy law.

You are solely responsible for backup of original files and for verifying delivery status before client commitments where your workflow is business critical.

Paid features are billed in INR using configured payment partners (including Razorpay). Subscription and one-time purchase terms, taxes, and plan limits are shown at checkout and in-app surfaces.

Recurring charges continue until cancellation is processed. Trial conversion, subscription state changes, mandate pauses, and downgrade timing can complete asynchronously across payment provider and platform systems.

Where recurring card/e-mandate billing applies, payments are processed subject to applicable RBI rules and payment network requirements, including pre-debit notifications and user mandate controls handled through the payment provider flow.

Unless otherwise stated in writing, payments are non-refundable except where required by law. This generally means one-time photo packs and already-consumed platform usage are not refundable once activated or delivered.

You may pause, resume, or downgrade subscription states where those options are available in your plan. Cancelling a recurring subscription normally stops future renewals while service may continue until the end of the paid billing window unless a plan or support-approved exception states otherwise.

Downgrade or cancellation requests are treated as received when accepted by the PhotoSelect backend. Final billing closure may additionally depend on provider-side mandate or subscription cancellation confirmation.

If a customer downgrades or abandons paid storage while media remains hosted beyond the included allowance, PhotoSelect may require upgrade, export, or deletion action within a reasonable notice period before long-term retention is discontinued.

We aim for high reliability but do not guarantee uninterrupted or error-free service. Maintenance, network issues, third-party dependencies, or force majeure may affect availability.

PhotoSelect integrates third-party providers for payments, messaging/OTP, cloud storage, and analytics/observability. Their terms and policies may apply to those service components.

Current subprocessors are listed at /subprocessors and may be updated from time to time.

PhotoSelect and its software, branding, and non-customer content are protected by applicable intellectual property laws. These Terms do not transfer ownership of PhotoSelect intellectual property to you.

To the maximum extent permitted by law, PhotoSelect is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, goodwill, or data.

Total aggregate liability for claims arising from paid services is limited to fees paid to PhotoSelect for the relevant service period, except where law does not permit such limitation.

You agree to indemnify and hold PhotoSelect harmless from claims arising out of your use of the service, your content, or your violation of these Terms or applicable law.

We may suspend or terminate access for material violations, abuse, fraud, or legal risk. You may stop using the service at any time, including by account deletion where available.

If an account is in arrears, inactive after downgrade, or otherwise no longer entitled to paid storage, PhotoSelect may suspend access and delete stored media after at least 30 days notice, subject to legal retention obligations.

These Terms are governed by the laws of India. Subject to applicable law, courts in Bengaluru, Karnataka have exclusive jurisdiction over disputes arising from these Terms.

We may revise these Terms from time to time. Continued use of the service after updates constitutes acceptance of the revised Terms.
